Boobamilk offers this website, including all information, tools and other services available from this site, and its products (all collectively referred to as “Products and Services”), to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices set forth in these Terms & Conditions (“Terms”), including those incorporated by reference such as Boobamilk’s Privacy Policy (collectively “Terms & Conditions”).

By accessing or using our site or otherwise purchasing or using our Products and Services, you agree to be bound by these Terms & Conditions. These Terms & Conditions apply to all users and purchasers of our Products and Services, including without limitation users who are browsers, customers, vendors, merchants and/or contributors of content. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our Products and Services to you.

By agreeing to these Terms & Conditions, you represent that you are at least the age of majority in your state or country of residence, or that you are the age of majority in your state or country of residence and you have given us your consent to allow any of your minor dependents to use this site. All descriptions of Products and Services on our site are subject to change at any time without notice, at our sole discretion. We have made every effort to display as accurately as possible the colors and images of our Products and Services that appear on our site, including in our store. We reserve the right to modify the contents of our website at any time, but we have no obligation to do so. You agree that it is your responsibility to monitor changes to our site.

SECTION 4 – ORDERS FOR PRODUCTS AND/OR SERVICES

Order Acceptance; Shipment. Once we receive your order for a product or service, we will provide you with an order confirmation. Your receipt of an order confirmation, however, does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell; we are simply confirming that we received your order. We reserve the right at any time after receiving your order to accept or decline your order for any reason and in our sole discretion. If we cancel an order after you have already been billed, then we will refund the billed amount. Title and risk of loss for any purchases of physical products pass to you upon our delivery to our carrier. We reserve the right to ship partial orders (at no additional cost to you). The portion of any order that is partially shipped may be charged at the time of shipment. All orders are shipped using one of our third-party couriers. Online tracking may be available at our courier’s website (for example, FedEx), though we make no warranties regarding its availability because it is not under our control. While deliveries may be scheduled for a specified arrival, we cannot guarantee delivery by any specific date or time.

Return, Refund and Exchange Policy. To ensure the safety and quality of our product, we do not accept returns or credit for unused Boobamilk products.

If you are dissatisfied with your order, please contact us within 45 days of your purchase at info@boobamilk.com. Refunds to your original method of payment can take up to 10 business days to process. Refunds do not include the cost of shipping. If it has been more than 10 business days and you have not received your refund, please contact us at info@boobamilk.com.

SECTION 5 - MODIFICATIONS TO PRODUCTS, SERVICES & PRICES

Prices for our Products and Services are subject to change without notice at any time.

We also reserve the right to modify or discontinue our Products or Services (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of a Product or Service.

SECTION 6 – CERTAIN PRODUCTS OR SERVICES; ORDER LIMITATIONS

Certain Products or Services may be available exclusively online through our website. These Products or Services may be available only in limited quantities and are subject to return only according to our Return Policy.

To the fullest extent allowed by applicable law, we reserve the right, in our sole discretion, to refuse any order placed with us. Also to the fullest extent allowed by applicable law, we may, in our sole discretion, limit or cancel quantities purchased overall or per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

To the fullest extent allowed by applicable law, we reserve the right, but are not obligated, to (1) limit the sales of our Products and Services to any person, geographic region or jurisdiction, and (2) limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

Any offer of any Product or Service made on our website is void where prohibited by law.

You grant Boobamilk a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display any content you submit to Boobamilk in connection with the Website (e.g. comments to stories, curation of story collections and related links and images, etc.) (“User Submissions”) throughout the world in any media. We may use and display the name and/or any voice or likeness contained in any User Submission. We may, but have no obligation to, monitor and edit or remove any activity or content. We take no responsibility and assume no liability for any content posted by you or any third party. As between us and you and apart from the licenses granted hereunder, you retain all rights in your User Submissions. User Submissions are not confidential, and we are under no obligation to maintain as confidential any information, in whatever form, contained in any User Submission. Boobamilk may sell, license and/or display any advertising, attribution, links, promotional and/or distribution rights in connection with your User Submission, and Boobamilk and its licensors or affiliates may retain any and all revenue generated from any sales or licenses of such advertising, attribution, links, or promotional or distribution rights. Nothing in these terms obligates or may be deemed to obligate Boobamilk to sell, license, or offer to sell or license any advertising, promotion, or distribution rights. User Submissions do not represent the views of Boobamilk or any individual associated with Boobamilk, and we do not control this Content. In no event shall you represent or suggest, directly or indirectly, Boobamilk’s endorsement of User Submissions. Through your use of the Website and Products and Services, you may be exposed to Content that you may find offensive, objectionable, harmful, inaccurate or deceptive. Boobamilk does not take any responsibility or assume any liability for any actions you may take as a result of reading User Submissions. User Reviews. If you have purchased Boobamilk, you may email, post, upload, or submit content you have created, including photographs, videos, reviews and comments (collectively, “User Submissions”) through www.boobamilk.com or directly via email. By posting, uploading, or sharing User Submissions, you agree to the following guidelines and rules and grant Boobamilk LLC and our third-party content-management service providers the perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable right to use your User Submissions for any purpose (including educational and promotional), in Boobamilk’s sole discretion. You will not be compensated for your User Submission. In making a User Submission, you also agree to hold Boobamilk LLC and any person acting on our behalf harmless from any liability related in any way to the use of your User Submissions.

Boobamilk reserves the right not to post your User Submission or to remove any posted User Submission for any reason at any time, including but not limited to if the User Submission violates our guidelines or includes any of the following:

• Inappropriate comments, discriminatory language, hate speech, threats, trolling
• Third party URLs or promotion of third party products
• Personally identifiable information (address, full name, email address, phone number, etc)
• Spam content
• Content, materials, images, videos, trademarks, copyrights, etc for materials or rights that you do not own and for which you don’t have a right to
• Discussion of medical conditions or claims of medical effectiveness outside of the stated product benefits
• Reviews that are related to customer service or delivery experiences but not about the product itself
• User Submissions which include images, videos, or any likeness of children under 18 for whom you are not the parent or legal guardian
